These Terms of Use ("Terms") govern your use of DocTakeoff (the "Service"), a web application operated by Kastle REDI, LLC ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
DocTakeoff lets you view PDF documents, place markups, and produce measurements and estimates in your web browser. Your documents are processed locally on your device and are not uploaded to our servers. The Service is currently offered as a beta, free of charge, and may change, be interrupted, or be discontinued at any time without notice.
The Service is a software tool. It does not provide, and is not a substitute for, professional services or judgment, including that of licensed engineers, architects, surveyors, estimators, or contractors. No professional relationship of any kind is created by your use of the Service. Outputs depend on the accuracy of the documents you load and the settings you choose, including scale, and may contain errors.
We ask for your email address so we can connect your feedback to you, and we may contact you about the Service. Feedback you submit may be used to improve the Service without obligation or compensation. We do not sell your email address. Your documents and markups remain on your device unless you choose to export or share them yourself.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, ERROR-FREE, SECURE, OR UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KASTLE REDI, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US $100).
You agree to defend, indemnify, and hold harmless Kastle REDI, LLC from and against claims, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your documents, or your violation of these Terms, including any reliance by you or any third party on outputs of the Service that were not independently verified.
The Service, including its software, design, and branding, is owned by Kastle REDI, LLC and protected by law. You retain all rights to your own documents and markups. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your own business or personal purposes.
We may update these Terms from time to time. The "Last updated" date above reflects the current version. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Virginia, and you consent to their jurisdiction.
